These Terms of Use ("Terms") govern your access to and use of the GoBikeFit mobile application ("App"), operated by Guo Rong Ma ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Use of the App is also governed by Apple's standard End User License Agreement: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
1. Description of Service
GoBikeFit analyzes photos you provide to estimate bicycle fit measurements (including saddle height, reach and drop, and cleat position) and generates adjustment recommendations. All photo analysis is performed on your device; your photos are not uploaded to or stored on our servers.
2. No Medical or Professional Advice
GoBikeFit provides general fit estimates for informational purposes only. It is not a substitute for a professional bike fitting, medical advice, or guidance from a qualified coach, physical therapist, or physician. Adjusting your bicycle or riding position carries inherent risk of injury. You assume all risk associated with any changes you make to your bicycle based on the App's recommendations, and you should consult a professional before making significant equipment or position changes, particularly if you have an existing injury or medical condition.
3. Subscriptions and Billing
3.1 Certain features of the App ("Pro") require a paid subscription or one-time purchase, billed through the Apple App Store (or other applicable app store).
3.2 Subscriptions automatically renew for the same term unless canceled at least 24 hours before the end of the current period. Your payment method will be charged for renewal within 24 hours prior to the end of the current period.
3.3 If offered, free trials convert automatically into a paid subscription at the end of the trial period unless canceled before the trial ends.
3.4 You can manage or cancel your subscription at any time through your App Store account settings. We do not process payments or refunds directly — all billing is handled by the app store through which you purchased.
3.5 Prices are subject to change; we will provide notice as required by the applicable app store's policies before any price change takes effect for existing subscribers.
4. Acceptable Use
You agree not to: (a) reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law; (b) use the App for any unlawful purpose; or (c) interfere with or disrupt the App's operation.
5. Intellectual Property
The App, including its design, features, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
6. Your Content
Photos and data you capture in the App remain yours. Since analysis runs on-device and we do not receive your photos, we do not claim any ownership or license over them.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT FIT RECOMMENDATIONS WILL BE ACCURATE, ERROR-FREE, OR SUITABLE FOR YOUR SPECIFIC PHYSIOLOGY OR EQUIPMENT.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, INJURY, OR PROPERTY DAMAGE ARISING FROM YOUR USE OF THE APP OR RELIANCE ON ITS RECOMMENDATIONS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App and cancel your subscription at any time.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of Ontario, Canada, without regard to its conflict of law principles.
